Shareholder Kevin Johnson and Associate Chris Johnson were recently published in the Winter 2017 edition of the Florida Restaurant & Lodging Magazine. Their article discusses the current state of the Department of Labor’s “20% rule” that attempts to restrain the amount of time that tipped workers can spend performing sidework. The article provides guidance on interpreting the relevant regulation and DOL Handbook provision that the rule arises from and discloses insight on the shift in deference that courts are giving the “20% rule” in recent opinions.
